BAJO NINGUNA CIRCUNSTANCIA TU SALUD VIRTUAL, SUS LICENCIANTES, LICENCIADOS O PROVEEDORES SERÁN RESPONSABLES DE NINGÚN DAÑO PUNITIVO, EJEMPLAR, CONSECUENTE, INCIDENTAL, INDIRECTO O ESPECIAL (INCLUYENDO, SIN LIMITACIÓN, CUALQUIER LESIÓN PERSONAL, PÉRDIDA DE GANANCIAS, INTERRUPCIÓN DEL NEGOCIO, PÉRDIDA DE PROGRAMAS U OTROS DATOS EN SU COMPUTADORA O DE OTRA MANERA) QUE SURJA DE O EN CONEXIÓN CON SU USO DEL SITIO WEB, YA SEA BAJO UNA TEORÍA DE INCUMPLIMIENTO DE CONTRATO, NEGLIGENCIA, RESPONSABILIDAD ESTRICTA, MALA PRAXIS O DE OTRA MANERA, INCLUSO SI NOSOTROS O ELLOS HEMOS SIDO ADVERTIDOS DE LA POSIBILIDAD DE TALES DAÑOS. POR LA PRESENTE, USTED LIBERA A TU SALUD VIRTUAL Y MANTIENE A TU SALUD VIRTUAL, SUS LICENCIANTES Y PROVEEDORES INDEMNES DE TODAS Y CADA UNA DE LAS RECLAMACIONES, DEMANDAS Y DAÑOS DE CADA TIPO Y NATURALEZA (INCLUYENDO, SIN LIMITACIÓN, REALES, ESPECIALES, INCIDENTALES Y CONSECUENTES), CONOCIDOS Y DESCONOCIDOS, SOSPECHADOS Y NO SOSPECHADOS, REVELADOS Y NO REVELADOS, QUE SURJAN DE O EN CUALQUIER FORMA RELACIONADOS CON SU USO DEL SITIO WEB. USTED RENUNCIA A LAS DISPOSICIONES DE CUALQUIER LEY ESTATAL O LOCAL QUE LIMITE O PROHÍBA UNA LIBERACIÓN GENERAL.
12. Ley Aplicable
Estos Términos de Uso y su uso del sitio web se regirán por las leyes de la Mancomunidad de Puerto Rico sin tener en cuenta sus principios de conflicto de leyes. Cualquier acción o procedimiento legal relacionado con este sitio web se presentará exclusivamente en un tribunal local de jurisdicción competente con sede en San Juan, Puerto Rico.
13. Consentimiento Informado
Al hacer clic en el botón “ACEPTAR” en la plataforma en el momento de la consulta de telesalud, usted reconoce que está dando su consentimiento para recibir atención a través del Servicio. El alcance de la atención será a entera discreción del proveedor de atención médica que lo esté tratando, sin garantía de diagnóstico, tratamiento o prescripción. El proveedor de atención médica determinará si la afección que se está diagnosticando y/o tratando es apropiada para un encuentro de telesalud a través del Servicio. El Servicio respeta y mantiene la confidencialidad del paciente con respecto a la información de salud protegida según lo delineado por la Ley de Portabilidad y Responsabilidad del Seguro de Salud (“HIPAA”), y, sujeto a las regulaciones de HIPAA, obtendrá el consentimiento expreso del paciente antes de compartir cualquier información de identificación del paciente con un tercero para fines distintos al tratamiento, pago u operaciones de atención médica. Además, al hacer clic en el botón “ACEPTAR”, usted autoriza a los proveedores de TU SALUD VIRTUAL a divulgar su información de contacto a TU SALUD VIRTUAL únicamente para que American Well le proporcione materiales de marketing que promuevan el Servicio. Usted puede optar por no recibir dichos materiales de marketing contactándonos en contact@tusaludvirtual.com. Finalmente, al usar el Servicio, se le puede preguntar si desea compartir cierta PHI (Información de Salud Personal) recopilada por HealthKit de Apple con American Well. Al hacer clic en “SINCRONIZAR”, usted autoriza a TU SALUD VIRTUAL a recopilar y a los proveedores de TU SALUD VIRTUAL a utilizar dicha PHI.
14. Consentimiento Informado realizado por proveedores de TU SALUD VIRTUAL
- La telemedicina implica el uso de comunicaciones electrónicas para permitir que los proveedores de atención médica en sitios remotos de los pacientes proporcionen servicios de consulta. Los proveedores pueden incluir médicos de atención primaria, especialistas y/o subespecialistas. La información puede usarse para diagnóstico, terapia, seguimiento y/o educación, y puede incluir audio y video bidireccionales en vivo y otros materiales (por ejemplo, registros médicos, datos de dispositivos médicos).
- Los sistemas de comunicación utilizados incorporarán protocolos de seguridad de red y software para proteger la confidencialidad de la información del paciente e incluirán medidas razonables para salvaguardar los datos y garantizar su integridad contra la corrupción intencional o no intencional.
- Se proporcionará un resumen del encuentro al paciente al final de cada encuentro que puede guardarse para los registros del paciente y puede compartirse con el médico de atención primaria local del paciente u otro proveedor, según corresponda.
15. Beneficios Anticipados de la Telemedicina
- Mejora del acceso a la atención médica al permitir que un paciente permanezca en su hogar o oficina mientras consulta a un clínico.
- Evaluación y gestión médica más eficientes.
16. Posibles Riesgos de la Telemedicina
Al igual que con cualquier procedimiento médico, existen riesgos potenciales asociados con el uso de la telemedicina. Los proveedores de TU SALUD VIRTUAL creen que la probabilidad de que estos riesgos se materialicen es muy baja. Estos riesgos pueden incluir, sin limitación, los siguientes:
- Pueden ocurrir retrasos en la evaluación y consulta o tratamiento médico debido a deficiencias o fallas del equipo.
- Los protocolos de seguridad podrían fallar, causando una violación de la privacidad de la información médica personal.
- La falta de acceso a registros médicos completos puede resultar en interacciones medicamentosas adversas o reacciones alérgicas o otros resultados negativos.
17. Al aceptar estos Términos de Uso, usted reconoce que comprende y acepta lo siguiente:
- Entiendo que las leyes que protegen la privacidad y la confidencialidad de la información médica también se aplican a la telemedicina; he recibido el Aviso de Prácticas de Privacidad de TU SALUD VIRTUAL que explica estos problemas con mayor detalle.
- Entiendo que la telemedicina puede implicar la comunicación electrónica de mi información médica personal a profesionales médicos que pueden estar ubicados en otras áreas, incluso fuera del estado.
- Entiendo que puedo esperar los beneficios anticipados del uso de la telemedicina en mi atención, pero que no se pueden garantizar ni asegurar resultados.
- Entiendo que mi información de atención médica puede ser compartida con otras personas para fines de tratamiento, pago y operaciones de atención médica. Las notas de psicoterapia son mantenidas por los clínicos pero no se comparten con otros, mientras que los códigos de facturación y los resúmenes de encuentros se comparten con otros y conmigo. Si obtengo psicoterapia de un proveedor de TU SALUD VIRTUAL, entiendo que mi terapeuta tiene el derecho de limitar la información que se me proporciona si, a juicio profesional de mi terapeuta, compartir la información conmigo sería perjudicial para mí.
- Además, entiendo que mi información de atención médica puede compartirse en las siguientes circunstancias:
- Cuando se emite una orden judicial válida para registros médicos.
- Al informar sospechas de abuso, negligencia o violencia doméstica.
- Para prevenir o reducir una amenaza grave a la salud o seguridad de cualquier persona.
18. Consentimiento del Paciente para el Uso de la Telemedicina
He leído y entiendo la información proporcionada anteriormente, y entiendo los riesgos y beneficios de la telemedicina, y al aceptar estos Términos de Uso, por la presente doy mi consentimiento informado para participar en una visita de telemedicina bajo los términos descritos aquí.
19. Autorización de Pago
- Al aceptar estos términos de uso, usted autoriza a American Well a cargar en su tarjeta de crédito el monto total adeudado por usted con respecto a su consulta. Tenga en cuenta que es posible que TU SALUD VIRTUAL no reciba información completa o total de su plan de salud con respecto al copago aplicable que debe pagar por su consulta. Como tal, es posible que se le facture varias veces con respecto a una consulta: una vez antes de comenzar la visita y una segunda vez una vez que su plan de salud nos haya informado qué copagos adicionales, si los hubiera, debe pagar.
- Entiendo que esta autorización para facturar mi tarjeta de crédito o débito (incluido cualquier otro mecanismo de pago aceptado por American Well) permanecerá en vigor hasta que la cancele por escrito, y acepto notificar a American Well por escrito cualquier cambio en la información de mi cuenta. En el caso de que una Transacción ACH sea rechazada por Fondos Insuficientes (NSF), entiendo que TU SALUD VIRTUAL puede, a su discreción, intentar procesar el cargo nuevamente en cualquier momento dentro de los 30 días. Reconozco que la originación de las transacciones ACH a mi cuenta debe cumplir con las disposiciones de la ley de EE. UU. Certifico que soy un usuario autorizado de esta tarjeta de crédito/cuenta bancaria y no disputaré estas transacciones programadas con mi banco o compañía de tarjeta de crédito; siempre y cuando las transacciones correspondan al copago requerido por mi plan de salud.

YOU WAIVE THE PROVISIONS OF ANY STATE OR LOCAL LAW LIMITING OR PROHIBITING A GENERAL RELEASE.
12. Governing Law
These Terms of Use and your use of the website shall be governed by the laws of the Commonwealth of Puerto Rico without regard to its conflict of laws principles. Any legal action or proceeding related to this Website shall be brought exclusively in a local court of competent jurisdiction sitting in San Juan, Puerto Rico.
13. Informed Consent
By clicking the “AGREE or ACCEPT” button in the in the platform at the time of Telehealth consultation you acknowledge that you are consenting to receiving care via the Service. The scope of care will be at the sole discretion of the healthcare provider who is treating you, with no guarantee of diagnosis, treatment, or prescription. The healthcare provider will determine whether or not the condition being diagnosed and/or treated is appropriate for a telehealth encounter via the Service. The Service respects and upholds patient confidentiality with respect to protected health information as outlined by the Health Insurance Portability and Accountability Act (“HIPAA”), and, subject to HIPAA regulations, will obtain express patient consent prior to sharing any patient-identifiable information to a third party for purposes other than treatment, payment or health care operations. In addition, by clicking the “AGREE” button you are authorizing TU SALUD VIRTUAL providers to release your contact information to TU SALUD VIRTUAL solely in order for American Well to provide you with marketing materials promoting the Service. You may opt out of receiving such marketing materials by contacting us at contact@tusaludvirtual.com. Finally, when using the Service you may be asked if you would like to share certain PHI collected by Apple’s HealthKit with American Well. By clicking on “SYNC” you are authorizing TU SALUD VIRTUAL to collect and TU SALUD VIRTUAL providers to utilize such PHI.
14. Informed Consent performed by TU SALUD VIRTUAL providers
- Telemedicine involves the use of electronic communications to enable health care providers at sites remote from patients to provide consultative services. Providers may include primary care practitioners, specialists, and/or subspecialists. The information may be used for diagnosis, therapy, follow-up and/or education, and may include live two-way audio and video and other materials (e.g. medical records, data from medical devices).
- The communications systems used will incorporate network and software security protocols to protect the confidentiality of patient information and will include reasonable measures to safeguard the data and to ensure its integrity against intentional or unintentional corruption.
- An encounter summary will be provided to the patient at the end of each encounter which may be kept for the patient’s records and may be shared with the patient’s local primary care or other provider, as appropriate.
15. Anticipated Benefits of Telemedicine
- Improved access to medical care by enabling a patient to remain at his or her home or office while consulting a clinician.
- More efficient medical evaluation and management.
16. Possible Risks of Telemedicine
As with any medical procedure, there are potential risks associated with the use of telemedicine. TU SALUD VIRTUAL providers believes that the likelihood of these risks materializing is very low. These risks may include, without limitation, the following:
- Delays in medical evaluation and consultation or treatment may occur due to deficiencies or failures of the equipment.
- Security protocols could fail, causing a breach of privacy of personal medical information.
- Lack of access to complete medical records may result in adverse drug interactions or allergic reactions or other negative outcomes.
17. By accepting these Terms of Use, you acknowledge that you understand and agree with the following:
- I understand that the laws that protect privacy and the confidentiality of medical information also apply to telemedicine; I have received the TU SALUD VIRTUAL Notice of Privacy Practices which explains these issues in greater detail.
- I understand that telemedicine may involve electronic communication of my personal medical information to medical practitioners who may be located in other areas, including out of state.
- I understand that I may expect the anticipated benefits from the use of telemedicine in my care, but that no results can be guaranteed or assured.
- I understand that my healthcare information may be shared with other individuals for treatment, payment and healthcare operations purposes. Psychotherapy notes are maintained by clinicians but are not shared with others, while billing codes and encounter summaries are shared with others and with me. If I obtain psychotherapy from TU SALUD VIRTUAL provider, I understand that my therapist has the right to limit the information provided to me if in my therapist’s professional judgment sharing the information with me would be harmful to me.
- I further understand that my healthcare information may be shared in the following circumstances:
- When a valid court order is issued for medical records.
- Reporting suspected abuse, neglect, or domestic violence.
- Preventing or reducing a serious threat to anyone’s health or safety.
18. Patient Consent to the Use of Telemedicine
I have read and understand the information provided above, and understand the risks and benefits of telemedicine, and by accepting these Terms of Use I hereby give my informed consent to participate in a telemedicine visit under the terms described herein.
19. Payment Authorization
- By accepting these terms of use, you are authorizing American Well to charge your credit card for the full amount due from you with respect to your consultation. Please note that TU SALUD VIRTUAL may not be given full or complete information from your health plan regarding the applicable co-pay due from you for your consultation. As such, you may be billed multiple times with respect to a consultation – once prior to beginning the visit and a second time once your health plan has advised us as to what additional co-pays, if any, you owe.
- I understand that this authorization to bill my credit card or debit card (including any other American Well accepted payment mechanism) will remain in effect until I cancel it in writing, and I agree to notify American Well in writing of any changes in my account information. In the case of an ACH Transaction being rejected for Non-Sufficient Funds (NSF), I understand that TU SALUD VIRTUAL may at its discretion attempt to process the charge again at any time within 30 days. I acknowledge that the origination of ACH transactions to my account must comply with the provisions of U.S. law. I certify that I am an authorized user of this credit card/bank account and will not dispute these scheduled transactions with my bank or credit card company; so long as the transactions correspond to the co-payment required by my health plan.
